These terms explain how Online Home Budget may be used, what the service is for, how paid access works, and the responsibilities that apply when you create or use an account.

These Terms & Conditions govern your access to and use of onlinehomebudget.com and any related services, tools, software, pages, features and support provided through the website.

In these Terms, “Online Home Budget”, “the Service”, “we”, “us” and “our” refer to Protosoft Pty Ltd. “You” and “your” refer to any person who accesses or uses the Service.

By accessing the website, creating an account, using the Service, contacting support, starting a free trial, or purchasing paid access, you agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use the Service.

Household record keeping Home Budget helps organise household money records and planning.
No auto-renewal Paid access is prepaid. Users choose whether to renew when access expires.
Data access matters Expired paid access may limit actions, but the product is designed not to trap records.

Changes to these Terms

We may update these Terms from time to time by publishing the revised version on this page. The updated Terms will apply from the date they are published, unless otherwise stated. You should review this page periodically to stay informed of any changes.

Purpose of the Service

Online Home Budget is a budgeting and record-keeping tool designed to help users organise and track household budget information. The Service is provided for general budgeting and organisational purposes only.

Online Home Budget does not provide financial, investment, taxation, legal, accounting or professional advice. You are responsible for your own financial decisions and should seek appropriate professional advice where required.

Important: Home Budget can help you organise records and see patterns, but it does not decide what you should do with your money.

Your account

You are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your account. You agree to provide accurate information when creating or using an account and to keep your account information reasonably up to date.

You must notify us if you become aware of any unauthorised access to your account or any other security issue affecting your use of the Service.

Your data

You retain ownership of the budget, account, transaction, category, note and other information that you enter into the Service. You grant us a limited right to host, store, back up, process and display your data only as reasonably required to provide, maintain, secure and support the Service.

We take reasonable steps to protect user data, but no online service can guarantee that data will never be lost, corrupted, accessed without authorisation, or affected by technical failure. You are responsible for keeping any separate records or backups that are important to you.

Privacy Policy

Our Privacy Policy explains how we collect, use, store and disclose personal information. By using the Service, you agree that your information will be handled in accordance with our Privacy Policy.

Billing, plans and paid access

Online Home Budget offers paid access on a prepaid basis. Users may purchase access for either one month or one year at the prices shown on the website at the time of purchase.

Online Home Budget does not automatically renew paid access. When your paid access period expires, you may choose whether to purchase a further period of access.

Payments may be processed by third-party payment providers such as Stripe, PayPal or credit card processors. Your use of those payment services may also be subject to the terms and privacy policies of the relevant payment provider.

Free trial

A free trial may be made available so that users can evaluate the Service before purchasing paid access. The free trial is provided so that you can decide whether the Service is suitable for your needs before making a payment.

Refund policy

Because users can trial the Service before purchase, payments are generally non-refundable once paid access has been purchased, except where required by law.

We do not provide refunds merely because you change your mind, stop using the Service, forget to use the Service, choose the wrong paid access period, or later decide that the Service is not suitable for your needs where the Service was available to trial before purchase.

If you believe you have been charged in error, or if you believe there is a problem with the Service that entitles you to a remedy under applicable law, you should contact us with details of the issue.

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.

Acceptable use

You agree to use the Service only for lawful purposes and in a way that does not interfere with the rights, security or use of the Service by others.

You must not use the Service to:

  • break any applicable law or regulation;
  • upload, submit, store, transmit or distribute unlawful, abusive, defamatory, obscene, fraudulent, misleading, harmful or offensive material;
  • infringe the intellectual property, privacy, confidentiality or other rights of any person or organisation;
  • send spam, unsolicited advertising, bulk messages or other unwanted communications;
  • upload or transmit viruses, malware, scripts, code or files intended to damage, disrupt, monitor, interfere with or gain unauthorised access to any system or data;
  • attempt to access accounts, systems, data or areas of the Service that you are not authorised to access;
  • use automated tools, bots, scrapers, spiders or similar methods to access, copy, extract or monitor the Service without our prior written permission;
  • place an unreasonable or excessive load on our infrastructure;
  • reverse engineer, decompile, disassemble, modify, copy, rent, lease, sell, resell or exploit any part of the Service except to the extent permitted by law;
  • remove copyright, trademark or proprietary notices from the Service;
  • impersonate any person or organisation, including Protosoft Pty Ltd or Online Home Budget representatives; or
  • use information obtained through the Service for purposes unrelated to your own legitimate use of the Service.

Content removal and account suspension

We may remove content, restrict access, suspend an account or terminate access to the Service if we reasonably believe that a user has breached these Terms, created a security risk, misused the Service, failed to pay for paid access, or acted in a way that may cause harm to us, the Service, other users or third parties.

Inactive accounts and data deletion

We may delete inactive accounts and associated data if an account has not been accessed for more than 365 days. We may apply shorter retention periods to trial, free, cancelled, expired or unpaid accounts.

Where practical, we may attempt to notify you before deleting account data, but we are not required to retain inactive account data indefinitely. Once data has been deleted, it may not be recoverable.

Intellectual property

The website, software, design, layout, text, graphics, logos, images, icons, code and other materials forming part of the Service are owned by or licensed to Protosoft Pty Ltd and are protected by copyright, trademark and other intellectual property laws.

Permitted use of website information

Availability and changes to the Service

We aim to keep the Service available and operating properly, but we do not guarantee that the Service will always be available, uninterrupted, secure, error-free or free from data loss.

We may modify, update, suspend, discontinue or restrict access to any part of the Service from time to time, including for maintenance, security, operational or business reasons.

Disclaimer and limitation of liability

To the maximum extent permitted by law, the Service and all information provided through the Service are supplied on an “as is” and “as available” basis. We do not make any warranties or representations that the Service will be complete, accurate, uninterrupted, secure, error-free, suitable for your particular needs, or free from defects.

Nothing in these Terms excludes, restricts or modifies any guarantee, warranty, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or any other applicable law.

To the maximum extent permitted by law, Protosoft Pty Ltd will not be liable for any indirect, incidental, special, consequential or economic loss, including loss of profit, loss of revenue, loss of data, loss of opportunity, business interruption, or loss arising from reliance on information entered into or generated by the Service.

To the maximum extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim arose.

Indemnity

You agree to indemnify Protosoft Pty Ltd against claims, losses, liabilities, damages, costs and expenses, including reasonable legal costs where recoverable by law, arising from your misuse of the Service, your breach of these Terms, your violation of any law, or your infringement of any third-party rights.

Governing law

These Terms are governed by the laws of Australia. You agree to submit to the jurisdiction of the courts of Australia for disputes relating to these Terms or your use of the Service.
